Terms and conditions
A. PREAMBLE
VRINAT AUTOMOCION SSCI SARL (hereinafter referred to as “The Rolling Museum”), as part of its activities, provides driving services, automotive experiences and travel experiences under the commercial name The Rolling Museum.
Registration and subsequent confirmation of a booking create a contractual relationship between the participant and The Rolling Museum.
These Terms and Conditions govern the booking and provision of these services and must be accepted by the participant at the time of booking.
Where an experience is subject to specific legislation relating to package travel, traveller protection or consumer protection, any mandatory rights provided by such legislation shall also apply.
B. GENERAL TERMS AND CONDITIONS
1. Conclusion of the Contract
By making a booking, the participant submits a binding request to book the selected experience with The Rolling Museum.
The booking shall be confirmed upon written confirmation from The Rolling Museum and payment of the amount due in accordance with these Terms and Conditions.
The Rolling Museum shall provide the participant with the essential information relating to the booked experience.
Where one person makes a booking on behalf of several participants, that person shall be responsible for communicating these Terms and Conditions and the relevant information regarding the experience to all participants included in the booking.
All participants must be at least 18 years old on the starting date of the experience.
To drive vehicles provided by The Rolling Museum, participants must be at least 30 years old and must have held a valid driving licence for at least 10 years.
Drivers must present a valid driving licence whenever requested by The Rolling Museum.
Failure to present a valid driving licence, the existence of an official driving ban, or failure to meet the above requirements shall result in the loss of the right to drive the vehicles, without entitlement to a refund on this basis.
2. Payment
To confirm and secure the booking, 50% of the total price of the experience must be paid at the time of booking.
The remaining 50% must be paid no later than 30 days before the start of the experience.
For bookings made 30 days or less before the start of the experience, 100% of the total price must be paid at the time of booking.
All prices are stated in euros (€) and include applicable VAT unless expressly stated otherwise.
The participant is responsible for making all payments within the specified deadlines.
Failure to pay any amount by the applicable due date may result, following notification to the participant, in cancellation of the booking by The Rolling Museum, without prejudice to any cancellation charges that may apply under these Terms and Conditions and applicable law.
3. Included Services and Programme
The services included in each experience shall be determined by the description published by The Rolling Museum, the corresponding offer and the written booking confirmation.
Depending on the experience, the services may include vehicles, accommodation, meals, activities, visits, technical assistance, instructors, transportation or other services expressly indicated.
Photographs, maps, routes, programmes, vehicles, hotels, restaurants and other elements used in communications and promotional materials are provided for illustrative purposes unless expressly stated to constitute an essential feature of the booked experience.
4. Changes to the Experience
Hotels, restaurants, activities, itineraries, roads, routes, schedules and other services indicated in the programme may be changed where necessary for reasons of availability, operations, logistics, weather conditions or safety.
The Rolling Museum reserves the right to replace such services with alternatives of a similar category and quality, provided that such changes do not substantially alter the overall nature of the booked experience.
Minor changes that do not substantially affect the main characteristics of the experience shall not, in themselves, entitle the participant to cancel the booking or receive a refund.
Where a change results in a significant reduction in the quality or value of the services originally booked, any applicable price reduction, alternative arrangements or other rights provided for under applicable law shall apply.
The Rolling Museum shall inform participants of any significant changes as soon as reasonably possible.
5. Unavoidable and Extraordinary Circumstances
In the event of unavoidable and extraordinary circumstances beyond the reasonable control of The Rolling Museum, the organisation may adapt the experience where necessary to ensure its proper operation and the safety of participants.
Such circumstances may include, but are not limited to, extreme weather conditions, fires, floods, natural disasters, epidemics, conflicts, civil unrest, strikes, road closures, restrictions or decisions imposed by public authorities, major transport disruptions or any other circumstances significantly affecting the operation of the experience.
Such adaptations may include changes to itineraries, roads, schedules, accommodation, restaurants, activities, vehicles or other elements of the programme.
The Rolling Museum shall make all reasonable efforts to provide suitable alternative arrangements and to maintain the overall nature and standard of the experience.
Where unavoidable and extraordinary circumstances make the experience impossible or unsafe to operate, The Rolling Museum may cancel the experience.
Where required by applicable law, the participant shall be entitled to a full refund of the amounts paid for the experience, without entitlement to additional compensation where the cancellation results from unavoidable and extraordinary circumstances.
The Rolling Museum shall not be responsible for expenses relating to services booked directly by the participant with third parties, such as flights, transportation, additional accommodation or other personal expenses, except where otherwise required by applicable law.
6. Minimum Number of Participants
Certain experiences may be subject to a minimum number of participants.
Where applicable, the required minimum number of participants shall be stated in the description of the experience, the offer, the pre-contractual documentation or the booking confirmation.
If the required minimum number of participants is not reached, The Rolling Museum may cancel the experience.
The Rolling Museum shall endeavour to notify participants of any cancellation due to insufficient participant numbers at least 60 days in advance, where circumstances permit, and in all cases in accordance with the deadlines and requirements established by applicable law.
In the event of cancellation because the minimum number of participants has not been reached, the participant shall be entitled to a full refund of all amounts paid to The Rolling Museum.
As an alternative to a refund, the participant may voluntarily agree to transfer the booking to another available date or experience.
Where cancellation is made in accordance with the conditions and deadlines permitted by applicable law, no additional compensation shall be due as a result of cancellation due to the minimum number of participants not being reached.
The Rolling Museum shall not be responsible for flights, transportation, additional accommodation or other services booked directly by the participant with third parties, except where otherwise required by applicable law.
7. Safety and Conduct
Instructions given by The Rolling Museum’s instructors, guides, technical staff and employees must be followed at all times.
Seat belts must be worn whenever the vehicle is equipped with them.
Smoking and the use of mobile phones or other mobile devices while driving are strictly prohibited.
A zero-tolerance policy (0.0‰) applies to alcohol, drugs and any other substances that may impair driving ability.
A participant may not drive where their ability may be affected by alcohol, drugs, medication, fatigue or any other circumstances that could compromise safety.
Reckless, dangerous or negligent behaviour, or failure to follow safety instructions, may result in the immediate withdrawal of the participant’s right to drive.
In the event of a serious or repeated breach, The Rolling Museum may exclude the participant from the experience where necessary to protect the safety of the participant, third parties, staff or vehicles.
Exclusion resulting from conduct attributable to the participant shall not entitle the participant to a refund.
8. Cancellation by the Participant
All cancellations must be communicated in writing to The Rolling Museum.
Except where applicable law grants the participant the right to terminate the contract without cancellation charges, the following conditions shall apply:
More than 90 days before the start of the experience:
Full refund.
Between 90 and 61 days before the start of the experience:
Cancellation charge equal to 25% of the total price of the experience.

Cancellation charge equal to 100% of the total price, with no entitlement to a refund.
Where a refund is due, The Rolling Museum shall refund the participant any amounts paid in excess of the applicable cancellation charges.
Unavoidable and Extraordinary Circumstances
The cancellation charges set out above shall not apply where the participant is legally entitled to terminate the contract without penalty due to unavoidable and extraordinary circumstances occurring at the destination or in its immediate vicinity and significantly affecting the performance of the experience or the transportation of participants to the destination.
In such circumstances, and where provided for by applicable law, the participant shall be entitled to a full refund of the amounts paid for the experience, without entitlement to additional compensation.
C. SPECIAL CONDITIONS – VEHICLES AND DRIVING EXPERIENCES
1. Vehicles Provided
Vehicles shall be provided during the experience in accordance with the general characteristics described by The Rolling Museum.
Before driving, participants may be required to sign the relevant vehicle handover, liability and usage documentation.
Each vehicle is generally shared by two participants.
Single-driver arrangements are subject to availability and may involve an additional charge.
2. Availability of the Collection
The vehicle collection presented on The Rolling Museum’s website, presentations, brochures, photographs or other materials is provided for indicative purposes only.
The presentation of a vehicle as part of the collection does not guarantee that such vehicle will be available or used during a particular experience.
Likewise, there is no guarantee that all vehicles in the collection will participate in each experience.
The number and selection of vehicles used may vary depending on the number of participants, vehicle availability, maintenance requirements, breakdowns or mechanical issues, as well as operational, logistical, weather-related or safety requirements.
The Rolling Museum reserves the right to select, replace or withdraw vehicles from the collection before or during an experience where reasonably necessary.
If an advertised vehicle is unavailable, The Rolling Museum shall endeavour, whenever possible, to replace it with another classic Porsche providing a comparable driving experience.
A reasonable change to the selection of vehicles shall not, in itself, entitle the participant to cancel the booking or receive a refund, provided that it does not substantially alter the nature of the booked experience and without prejudice to any rights granted under applicable law.
3. Vehicle Rotation and Use
The Rolling Museum organises its experiences using a rotation system between the available vehicles.
The organisation shall endeavour to allow participants to drive different vehicles during the experience.
For operational, safety, maintenance, traffic, weather, availability or other unforeseen reasons, it cannot be guaranteed that every participant will drive every available vehicle or any specific model.
The duration, number and order of rotations may be adapted during the experience according to the circumstances.
4. Insurance and Liability
The vehicles used during the experience have the relevant insurance coverage, which may vary depending on the vehicle.
The participant shall be subject to a maximum excess of EUR 5,000 per claim, unless expressly stated otherwise before use of the vehicle.
The participant may be held liable for the full amount of any damage in the event of intentional misconduct, gross negligence, driving under the influence of alcohol or drugs, unauthorised use of the vehicle or serious failure to comply with safety instructions.
Specific conditions applicable to each vehicle may be communicated to the participant before its use.
D. PHOTOGRAPHY, VIDEO, MEDIA AND DATA
1. Content Created by Participants
Photographs and videos taken by participants during the experience may be used for private purposes.
Any professional or commercial use of images of the vehicles, the organisation, staff or the experience requires prior authorisation from The Rolling Museum.
The use of drones, cameras mounted on the exterior of vehicles or action cameras such as GoPro is subject to prior authorisation from The Rolling Museum.
The Rolling Museum may restrict any recording equipment where its use could affect safety, privacy, compliance with applicable regulations or the proper organisation of the experience.
2. Content Created by The Rolling Museum
The Rolling Museum may take photographs and make video recordings during its experiences for communication and promotional purposes.
The processing and use of images in which participants are identifiable shall be carried out in accordance with applicable law.
Participants may inform The Rolling Museum, before the start of the experience, of any objection or limitation regarding the use of their image where permitted under applicable law.
3. Data Protection
Personal data shall be processed for the purposes of managing bookings, providing the booked services, communicating with participants and complying with applicable legal obligations.
Personal data shall be processed in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR), where applicable.
E. FINAL PROVISIONS
1. Legal Rights of the Participant
Nothing in these Terms and Conditions is intended to exclude or limit any mandatory rights granted to the participant under applicable law.
In the event of any conflict between a provision of these Terms and Conditions and a mandatory provision of applicable law, the mandatory legal provision shall prevail.
